DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS

DUBERRY HILLS
KING COUNTY, WASHINGTON

DESCRIPTION OF THE LAND

THIS AMENDED AND RESTATED DECLARATION is made the 24th day of June, 2003, by the undersigned, hereinafter referred to as "Declarant," who is the Successor Declarant pursuant to that certain Assignment and Assumption of Declarant Rights recorded under King County Recording Number 20030624001532 and who is the owner of more than one Lot in the Project. Declarant makes this Amended and Restated Declaration, upon Declarant's sole signature, and as attorney-in-fact for all Lot Owners with irrevocable power coupled with an interest pursuant to Sections 14.3, 14.5 and/or 16.1 of the Declaration of Covenants, Conditions and Restrictions of Duberry Hills, recorded under King County Recording Number 20000324001278, which is hereby superseded and replaced.

DESCRIPTION OF THE LAND

  1. Declarant owns certain real property located within the State of Washington, which property and improvements are commonly known as DuBerry Hill Phase 1 and DuBerry Hill Phase 2, located in King County, Washington, and legally described in attached Exhibit A (the "Project"). All Common Areas of the Project are shown on the Plat Maps recorded in conjunction with this Declaration.
  2. For the benefit and protection of the Project, to enhance its value and attractiveness, and as an inducement to lenders and investors to make and purchase loans secured by Lots within the Project, Declarant agrees to provide herein for a method of use and architectural control within the Project.

NOW, THEREFORE, Declarant hereby declares that the Lots described herein shall be held, conveyed, encumbered, leased, rented, used, occupied and improved subject to the following uniform covenants, conditions, restrictions, reservations, grants of easement, rights, rights-of-way, liens, charges and equitable servitudes.

Any conveyance, transfer, sale, assignment, lease or sublease of a Lot in the Project, shall and hereby is deemed to incorporate by reference all provisions of this Declaration. The provisions of this Declaration shall be enforceable by Declarant, any Lot Owner, the Association, and any first mortgagee of any Lot.
